Could I Borrow?

Effective and last updated: September 16, 2026

Terms of Service

These Terms of Service (the “Terms”) govern access to and use of the Could I Borrow website, application, and related services (collectively, the “Service”). Please read them carefully.

Could I Borrow is operated by Rodolfo Inostroza, an individual based in Redmond, Washington, United States. Membership is free.

Important notice

Could I Borrow is primarily an inventory and coordination tool. Borrowing, lending, pickup, return, and use of any item are arranged directly between users and are undertaken at their own risk. We recommend using the Service only with people you know and trust. Could I Borrow does not provide insurance or guarantee any user, item, transaction, or return.

1. Agreement to these Terms

To use an account, you must explicitly confirm your eligibility and accept these Terms, and acknowledge our Privacy Policy. If you do not agree, do not create an account or use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering a contract to use the Service. You must provide accurate information, keep your login credentials secure, and promptly tell us if you suspect unauthorized access. You are responsible for activity through your account except to the extent caused by our failure to use reasonable security measures. The Service is initially intended for users in the United States.

3. What the Service does—and does not do

The Service helps users record personal inventory, selectively share item information, communicate, and track proposed or active loans. Could I Borrow is not a party to agreements between users and is not a lender, lessor, borrower, owner, bailee, broker, marketplace seller, carrier, escrow provider, insurer, guarantor, safety inspector, repair service, or dispute-resolution service. We do not take title to or possession of items.

We do not verify a user’s identity, background, authority, ownership, legal compliance, statements, or ability to return or replace an item. We do not inspect, certify, or guarantee an item’s existence, condition, quality, legality, safety, fitness, instructions, value, or suitability for a particular purpose. Profiles, circle membership, ratings, tags, and reviews are informational only and are not endorsements or guarantees.

4. Interact only with people you know and trust

The Service is designed for private groups and personal networks. We strongly recommend lending to and borrowing from people you already know and trust. A shared group, invitation, profile, rating, review, or prior transaction does not establish that a person is trustworthy or that a transaction is safe. Use independent judgment, communicate clearly, meet in a safe and appropriate location, and stop a transaction if anything appears unsafe, unlawful, misleading, or inconsistent with the agreement.

5. Agreements between users

Owners and borrowers make their own agreement about each item, including authorized users and uses, condition, accessories, pickup, custody, duration, return, cleaning, maintenance, damage, loss, and replacement. Any schedule, status, message, proposal, acceptance, rating, or other record in the Service is a coordination record; users remain responsible for confirming their agreement and complying with applicable law. Could I Borrow does not enforce user agreements, collect debts, determine fault, or decide disputes.

6. Assumption of risk

Lending, borrowing, transporting, storing, and using personal property can involve risks, including misuse, hidden defects, product recalls, inadequate instructions, allergic reactions, data loss, theft, non-return, property damage, bodily injury, disability, and death. To the fullest extent permitted by law, you knowingly and voluntarily assume the risks arising from your decision to list, lend, borrow, receive, transport, store, repair, clean, or use an item or to meet or interact with another user. You are responsible for deciding whether an item, person, meeting, location, and proposed use are appropriate for you.

7. No insurance

Could I Borrow does not offer, sell, arrange, provide, or administer insurance, a protection plan, a warranty, or reimbursement for any user or item. We do not insure against theft, loss, non-return, defects, damage, personal injury, property damage, or any other risk. Do not assume that a homeowner, renter, auto, umbrella, business, health, or other insurance policy covers a transaction. Users are solely responsible for consulting their own insurer or qualified adviser and obtaining any coverage they consider necessary before a transaction.

8. Owner responsibilities

When you list or lend an item, you are responsible for:

  • having the legal right and authority to possess and lend it;
  • describing it accurately and disclosing known defects, hazards, recalls, restrictions, missing parts, and prior damage;
  • providing available manufacturer warnings, manuals, protective equipment, and safe-use instructions;
  • confirming the borrower is authorized, competent, and legally permitted to possess and use it; and
  • complying with applicable laws, licenses, registrations, warranties, and insurance requirements.

9. Borrower responsibilities

When you borrow or receive an item, you are responsible for:

  • inspecting it and declining to accept or use it if it appears unsafe, defective, recalled, incomplete, or unsuitable;
  • using it only as agreed and in accordance with law, instructions, warnings, age limits, and required training or licensing;
  • keeping it secure and preventing access by unauthorized people, children, or anyone not qualified to use it;
  • stopping use immediately if a defect, damage, warning, recall, or unsafe condition appears; and
  • returning it on time in the agreed condition and addressing damage, loss, citations, fees, or other consequences directly with the owner.

10. Prohibited items and conduct

You may not use the Service to violate law; infringe another person’s rights; deceive, harass, threaten, discriminate against, or harm anyone; manipulate ratings or reviews; gain unauthorized access; distribute malware; scrape or overload the Service; or facilitate a commercial rental business without our written permission. You may not list or request stolen, counterfeit, recalled, illegal, unlawfully possessed, or inherently dangerous items, or any item whose transfer, possession, or use requires a license or approval that the parties do not have. This includes illegal drugs and controlled substances, weapons prohibited by applicable law, explosives, and hazardous materials. A user is responsible for checking all laws that apply to the item and transaction.

11. Your content

You retain ownership of content you submit. You grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, and display that content only as reasonably necessary to operate, secure, support, and improve the Service and to make it available to the people and groups you select. You represent that you have the rights needed to submit the content and grant this license. Do not post confidential information or another person’s personal information without permission.

We may remove content that violates these Terms or creates legal, security, or safety risk. Nothing in these Terms restricts your right to provide an honest review of Could I Borrow or its services. We may moderate user reviews that contain private information, harassment, threats, unlawful content, or content unrelated to the relevant interaction.

12. Privacy and communications

Our Privacy Policy explains how we collect, use, and share personal information. You control which circles can see shared inventory and whether to display an optional profile location, but no online service or sharing setting can guarantee complete privacy or security. Use a neighborhood or city—not a home address—in public or group-visible profile fields. Transaction participants are responsible for protecting personal information they receive from each other and using it only for the transaction or another purpose the person authorized.

13. Third-party services

The Service relies on or may link to third-party services, including authentication and hosting providers. Those services have their own terms and privacy practices. We are not responsible for third-party services, content, availability, or acts, but this does not limit any responsibility we have for selecting and overseeing our service providers as required by law.

Voluntary contributions

Contributing is always optional. It does not change your borrowing access, reputation, visibility or support priority, and does not buy features, rewards or other perks.

Contributions support Rodolfo Inostroza, the individual operating Could I Borrow. They are personal contributions, not tax-deductible charitable donations. Could I Borrow is not a tax-exempt charity.

The service remains free whether or not you contribute. A contribution does not purchase an item, a loan, an ownership interest or a promise of future features. Ko-fi and its connected payment processor apply their own terms and privacy notices; review the checkout details before paying.

The operator handles questions about contributions and refund requests. Use the contact form with your payment reference and reply email; do not include full card or bank details. We review requests individually. Nothing here limits any refund, dispute or other consumer right that applicable law gives you.

14. Service availability and account action

We may add, change, suspend, or discontinue features and may correct inaccurate Service records. We may warn, restrict, suspend, or terminate an account when we reasonably believe it violates these Terms, creates a safety, legal, fraud, or security risk, or threatens the Service or other users. We may act immediately when reasonably necessary, but will provide notice when practical. You may stop using the Service at any time and may request account deletion through our data deletion instructions.

15. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR THAT AN ITEM OR USER TRANSACTION WILL BE SAFE OR SUCCESSFUL. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COULD I BORROW AND ITS OPERATORS, AFFILIATES, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, USE, OR GOODWILL; OR LOSS, NON-RETURN, DEFECT, MISUSE, OR DAMAGE TO AN ITEM, PERSONAL INJURY, PROPERTY DAMAGE, OR USER CONDUCT ARISING OUT OF OR RELATED TO THE SERVICE OR A USER TRANSACTION, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF COULD I BORROW AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US, IF ANY, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING LIABILITY FOR OUR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD WHERE APPLICABLE LAW SO PROVIDES.

17. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Could I Borrow and its operators, affiliates, officers, directors, employees, and agents from third-party claims, damages, losses, liabilities, and reasonable legal fees arising from your content, your violation of these Terms or law, your item, or your lending, borrowing, possession, transport, storage, or use of an item. This obligation does not apply to the extent a claim was caused by the indemnified party’s own gross negligence, willful misconduct, or other conduct for which indemnification cannot lawfully be required.

18. Washington law and venue

These Terms are governed by the laws of the State of Washington and applicable United States federal law, without regard to conflict-of-laws rules. Any lawsuit arising out of or relating to these Terms or the Service must be brought in the state or federal courts located in King County, Washington, and each party consents to their jurisdiction and venue. This section does not prevent either party from bringing an eligible claim in small-claims court or seeking emergency injunctive relief. If the law where you live gives you consumer rights that cannot be waived or requires a different forum, those rights and requirements control.

19. Changes to these Terms

We may update these Terms as the Service changes or as law requires. We will post the revised Terms and update the date above. If a change materially reduces your rights or increases your obligations, we will provide reasonable advance notice through the Service or by email when required by law. Changes apply prospectively from their stated effective date. Continuing to use the Service after that date constitutes acceptance of the revised Terms to the extent permitted by law.

20. General terms

These Terms and the policies they incorporate are the entire agreement between you and us about the Service and replace prior agreements about the Service. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, financing, reorganization, or transfer of the Service, subject to applicable law. Section headings are for convenience only. Sections that by their nature should survive termination will survive.

21. Contact

Use our contact form for questions about these terms or legal notices. Account and privacy requests are reviewed after any necessary verification.
